California to start fining idling truckers

The California Trucking Association is reminding truckers who haul into the Golden State that as of January 1, sleeper berth tractors will no longer be allowed to idle when drivers are resting or sleeping. The limit for idling trucks is five minutes. Beyond that, drivers caught running the engine will be fined a minimum of $300.

Furthermore, on Feb. 15, state inspectors will begin checking for engine emission control labels as part of the routine roadside inspection program. Drivers with a missing or tampered label are subject to a $300 fine, with another $500 tacked on if proof or repair is not provided within 45 days.

Easy way out

I read about this happening in New Jersey or New York a few years ago. Here's how you get around it....

Bring a pet. when the cop tries to ticket you for idling, call the animal cruelty people and tell them that the cop wants you to let your dog or cat freeze to death. One law can not force you to break another, so the cop and the animal cruelty people will have to decide which is more important, ticketing you and letting your pet freeze, or not ticketing you and keeping your pet, and you, nice and cozy

Only issues with that is that not all companies allow pets.

Also, they will still ticket you, and while you can fight it, that means you have to take time off work to deal with it.

It is just an annoyance that drivers shouldn't have to deal with.

There are no exclusions for pets in the anti idle laws. A trucker with his 5 year old daughter was caught idling in NY. He was told to turn it off. He brought up his daughter. Basically, he was violating the law.

People have been thinking there is a pet exclusion when there never has been.
