Fuel surcharge legislation alive in both chambers of Congress

Truckers hauling loads for the Department of Defense can soon rest assured that if a fuel surcharge is paid on the load, they’ll get the surcharge if they bought the fuel – thanks to legislation recently passed by Congress.

The Department of Defense Authorization Act for Fiscal Year 2009, approved by the Senate on Saturday, Sept. 27, includes language that mandates the pass-through of any fuel surcharges collected on DOD loads to the person who bears the cost of the fuel. The bill had previously passed the House of Representatives and is now waiting for the president’s signature.

Although the Defense bill only addresses the pass-through of fuel surcharges on just DOD loads, the rest of the truckers out there on the road aren’t without hope.

A pair of bills that have been introduced in Congress seek mandatory pass-through of fuel surcharges on any load where a surcharge is collected. The bills seek to mandate pass-through of 100 percent of the surcharge to whoever actually pays for the fuel.

A bill introduced May 6 by Rep. Peter DeFazio, D-OR, and co-sponsored by Rep. Thomas Petri, R-WI, and Rep. Brad Ellsworth, D-IN, seeks to mandate 100 percent pass-through of fuel surcharges to whoever actually buys the fuel.

The bill, HR5977, “Truth in Reliable Understanding of Consumer Costs Act,” or the “TRUCC Act,” is identical to a bill introduced in the Senate – S2910 – in late April by Sen. Olympia Snowe, R-ME, and co-sponsored by Sen. Sherrod Brown, D-OH.

“These bills will go a long way toward helping truckers and their shipping customers weather the brutal cost of fuel,” said Todd Spencer, executive vice president of the Owner-Operator Independent Drivers Association.

The House version of the TRUCC Act is currently awaiting consideration by the House Subcommittee on Highways and Transit. The Senate bill is currently awaiting consideration in the Committee on Commerce, Science, and Transportation.

Truckers wanting to express their support of the TRUCC Act should call both of their senators and their representative. Those who don’t know who their lawmakers are can call the Capitol switchboard at 202-224-3121 and provide their ZIP code to the operator to be connected to the appropriate office.

ok folks I just got off the phone with several people in D.C. I also spent some time on the phone with OOIDA, and while the TRUCC act is not dead it sure is on the back burner.

I had a long discussion with an aid about what it would take to get this moving, her suggestion was to start a petition drive NOT an online petition but a REAL paper petition drive and if enough signatures could be had to take it to the senators and congresspeople and show them the interest.

so this is what i am asking is there enough people willing to take the time to go out and get the signatures needed to do this!!

if I get enough responses I will write up a petition, make copies get a PO box and when enough come back i will take them to D.C. myself and present them.

It will take more than just going out and getting a few signatures you must also find other people willing to not just sign one but to take one and they also find more people to sign and recruit even more people to get others to sing and distribute the petitions.

think of it as a pyramid scheme.

I will take the time and cover the expense of doing my part if there are enough willing to work with me on this goal

this is achievable if people are willing to work at it, it will take time but in the end would be worth it.

This is a real grassroots program so there will have to be some serious dedication to getting the job done, also there would be little expense to the individuals a few stamps some copying expenses ect. the biggest expense would be some of your time. so can you spare some??

I plan on it as soon as I get home, want to set up the po box at the same time, getting worried though the response to this plan so far is to say the least underwhelming make one wonder if most have thrown in the towel and given up.

Gearjammer...bro and I are still here fighting. As soon as you have the PO box set up...let me know. I have an idea, and we'll pursue this signature action. Find out from your rep the number of signatures we will need to get this bill out of committee.

actually S.S i was hoping you would take an interest I would like to run the petition by you when I get a draft finished I am sure you would have some good ideas on how to make it better and then I figured to post it here for final approval by the people that like and would work with it.

I would be honored to be part of this. As soon as you're ready, we'll get 'r' done. We need to start preparing for when the 111th convenes.
